Title

PUBLIC HEARING AND CONSIDERATION OF A RESOLUTION REGARDING PROPOSED SPECIAL ASSESSMENTS FOR INTERNAL IMPROVEMENTS IN THE COUNTY.

Presented by: Joe L Norton, Gilmore & Bell, PC, Bond Counsel.

RECOMMENDED ACTION: Conduct public hearing, receive comments and close public hearing.  Adopt the resolution.

Body

On May 22, 2013, the Board of County Commissioners (the “Board”) approved the Statement of Final Costs, Assessment Roll and Notice of Public Hearing for the project hereinafter set forth (the “Project”), set June 5, 2013 at 9:00 a.m. as the date for conduct of public hearing on the proposed assessments; and authorized notice of such public hearing to be published one time in the official newspaper of the County on May 24, 2013 and to be mailed on said date to the affected property owners.

The Project was authorized pursuant to K.S.A. 19-27,181 et seq., as amended by Charter Resolution No. 62 of the County, and was initiated by a petition signed by the owners of the property within the respective benefit districts.

The petition has been signed by 100% of the owners of record of the area within the proposed benefit district, as determined by Sedgwick County Public Works.  Lots 1 through 3, Block 1, Greenwich Plaza Addition, Sedgwick County, Kansas, will be assessed 100% of the Improvements.  In the event that that such parcel is subdivided, the assessment on that parcel shall be prorated to the new parcels on the basis of land area.

Subsequent to the conclusion of the public hearing, a resolution is submitted for consideration; which resolution will levy assessments for the above-referenced project.  100% of the costs of the project shall be assessed in the manner prescribed in the resolution.

Alternatives:

Decline to adopt the resolution, in which case the only funding source with which to pay project costs will be county-wide property taxes.

Financial Considerations:

The aggregate costs of the project ($56,869.09), less amounts paid by property owners within the pay-in period prescribed above will be included within the County's general obligation bond issue.  The Bonds will be amortized over 15 years.

Legal Considerations:

The Board of County Commissioners (the "Board") has heretofore authorized the Project within the County, all of which will be assessed to property owners benefited thereby and has provided notice in accordance with law.  At the conclusion of the public hearing, the Board will consider a resolution levying such assessments.  The property owners will have 30 days to pay against such special assessments.  Any amounts not so paid will be funded over a period of 15 years with the County's general obligation bonds.

Policy Considerations:

These proceedings are goverened by the Special Assessment Policy.
