RESOLUTION NOTIFYING THE ATTORNEY GENERAL AND THE LOCAL LAW ENFORCEMENT AGENCY OF EXEMPTION OF CERTAIN COUNTY BUILDINGS FROM THE APPLICATION OF SENATE SUBSTITUTE FOR HOUSE BILL (HB) 2052.

In August 2011, the Board adopted Resolution No. 172-2011to allow members of the public with conceal carry permits to possess their weapons in certain County buildings. The resolution provided a list of those buildings for which concealed carry would continue to be prohibited.
The legislature has passed, and the Governor has signed, Senate Substitute for HB 2052 (HB 2052 or the bill), which amends the Personal and Family Protection Act to allow concealed carry in municipal buildings, subject to certain exceptions or exemptions. That bill takes effect July 1, 2013.
The County may exempt buildings from application of HB 2052 for a period of six months starting July 1, 2013, by sending a list of the buildings exempted to the Attorney General, and to local law enforcement agencies with jurisdiction over the buildings. An additional four year exemption, starting January 1, 2014, can be obtained by preparing security plans for the buildings, and submitting notice to the Attorney General and local law enforcement agencies by December 31, 2013.
Staff has reviewed the existing list of County buildings where concealed carry is prohibited and, subject to limited changes, are proposing those buildings be exempted from application of HB 2052 by sending the Attorney General and local law enforcement agencies notice of the exemptions before July 1, 2013. This will allow staff the time to more fully review the status of these buildings, and if necessary develop security plans, in order to obtain the four year exemption after January 1, 2014.

Legal Considerations:The Board is authorized to exempt certain County municipal buildings from the application of Senate Substitute for HB 2052 from July 1, 2013, to December 31, 2013, by notifying the Attorney General and local law enforcement agencies with jurisdiction over the buildings being exempted from the legislation.
