APPROVAL OF AN AGREEMENT BETWEEN THE BOARD OF COUNTY COMMISSIONERS AND THE KANSAS HUMANE SOCIETY OF WICHITA, INC. FOR USE OF A PORTION OF SEDGWICK COUNTY PARK FOR THE PURPOSE OF SPONSORING AND HOSTING THE "WOOFSTOCK" EVENT FOR A PERIOD OF FIVE YEARS.

RECOMMENDED ACTION: Approve the agreement, and authorize the Chairman to sign.

This is a five year agreement with the Kansas Humane Society of Wichita, Inc. to allow the annual Woofstock event to be held at Sedgwick County Park. The event will be held annually on dates mutually agreed upon and must be scheduled with the Park Superintendent no later than April 1 each year. The term of this agreement is for five (5) years beginning on the date of execution of the agreement.
Financial Considerations: Fees and deposits will be paid in accordance with the county code, anticipated to be $350 for the current year.
Legal Considerations:
K.S.A. 19-212 allows the board of county commissioners to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities.
By the terms of the agreement, any closure of or controlled access to County road(s) requires a separate annual agreement. The Kansas Humane Society of Wichita, Inc agrees to coordinate with the Sheriff's Office with regard to traffic control upon the County roads.
This event has taken place in the park for many years. Similar terms and conditions have been entered into in prior agreements but for one year terms. A Certificate of Insurance, approved by the Office of the County Counselor, is required pursuant to section 5 of the agreement and has been provided for the current year.
