CONSIDERATION OF A PETITION FROM THEODORE JOHN AND LOUISE MARTIN FOR THE EXCLUSION OF THEIR PROPERTY FROM THE BOUNDARIES OF THE SEDGWICK COUNTY FIRE DISTRICT NUMBER ONE.

Background:
Pursuant to K.S.A. 19-3604(b) the following landowners have petitioned for the exclusion of land from the boundaries of the fire district: Martin, Theodore John and Louise C. - 34600 West 21st North, Cheney, Kansas 67025. The petition, duly signed by an owner of at least 10 percent of the area of the land seeking to alter the boundaries of the Sedgwick County Fire District Number One, have been filed in the Office of the County Clerk. A public hearing is necessary to determine the advisability of altering the boundaries of the Fire District to exclude the land pursuant to the petition.

Financial Considerations: The property is subject to $254.02 of property tax for the fire district.
Legal Considerations: K.S.A. 19-3604(b) provides that the territory of any organized fire district may be subsequently altered by the inclusion of new lands or by the exclusion of lands therein upon a petition to the Board of County Commissioners signed by the owners of at least 10 percent of the area of the lands sought to be included or excluded. If the proposed alteration is within the fringe area of a city, then at least a ¾ majority vote of the Board of County Commissioners is required to approve the alteration of the boundaries. In this case, the Petitioner is outside of the fringe area of any city and thus only a majority vote of the Board of County Commissioners is needed. If the Board of County Commissioners finds that the petition is sufficient, the Board may adopt and publish a resolution detaching the land described in the petition. Pursuant to K.S.A. 19-3606, such alteration must be completed by July 1 to be effective for the upcoming tax year.
