Resolution authorizing the Director of the Division of Health and Human Services and Department Directors to enter into certain facility rental contracts and agreements.

Recommended Action: Approve the resolution and authorize the Commissioners to sign.

 

Background: The departments of the Division of Health and Human Services, including Aging, COMCARE, Health, and CDDO, often enter into agreements with other community facilities for the purpose of renting their location to host an event to benefit staff, consumers, or the community at large. An example of this type of agreement would be the facility lease agreement with the Old Cowtown Museum for the Link 4 Life race which is done annually and costs $3,500.00. These short term agreements typically do not cost much money and are simple and predictable in their terms, and both the Division and County Commission would save time and resources by allowing Directors to sign these types of agreements. The Resolution is consistent with Charter 65 which states that "Provided authority has been granted by the appropriate division head, department director, or elected official any purchase (defined as the acquisition of goods, equipment, and services, including rentals, leases, and lease/purchases) not exceeding $10,000.00 may be made by a county employee." This Resolution would allow Directors to sign agreements related to rentals that would be included in this category. All agreements would continue to be reviewed and approved by the Sedgwick County Counselor's Office before being signed.

 

The County Commission will be notified when an agreement of this nature has been signed, and copies will be distributed to the Finance Department, County Clerk, and County Manager's Office.

 

Alternatives: Should this resolution not be approved, departments will continue to submit these facility rental agreements to the Board of County Commissioners for approval.

 

Financial Considerations: This resolution only relates to those agreements that are under $10,000.00.

 

Legal Considerations: The authority for this action is K.S.A. 19-101 and a simple majority vote is required.

 

Policy Considerations: All Sedgwick County policies have been followed in the development of this Resolution.
