Recommended Action: Approve the Agreement and authorize the Chairman to sign
The Boy Scouts of America, Quivera Council is sponsoring and hosting an "Eskimo Run" event at Lake Afton Park each year for a period of five years.
The County is granting the Scouting organization exclusive use of only the portion of the Park designated by the Park Superintendent for the sole purpose of sponsoring and holding the "Eskimo Run" event and related activities for one day each calendar year on date mutually agreed upon between the Boy Scouts and Park Superintendent. Specific event dates shall be scheduled no later than April 1 for the following year.
The use granted is limited to the portion of the Park shown highlighted on the Map in Exhibit A and are referred to as the Licensed Premises. All areas outside of the Licensed Premises will remain under the exclusive control of the County. Minimal adjustments to the Licensed Premises are permitted as needed and will be documented in writing.
The use granted excludes any authority for the Boy Scouts to close or control access to County road(s) for event activities; a separate agreement must be entered into by the parties. Regardless of whether closure or controlled access to County road(s) is required, the Boy Scouts agrees to coordinate with the Sheriff's Office with regard to traffic control upon the County road(s).
The Boy Scouts agrees to coordinate with the Park Superintendent, or his designee, concerning any conditions the Park Superintendent may have for the use of any property under his management and control.
The term of this Agreement begins on the date this agreement is approved and expires on April 30, 2019.
Financial Considerations: Fees and deposits for this event shall be made in accordance with the Fee Schedule outlined in Exhibit B. If shelter houses are to be used by the Boy Scouts, fees and deposit shall be made in accordance with the Shelter House Permit, Exhibit C.
Legal Considerations: K.S.A. 19-212 allows the board of county commissioners to make such orders concerning county property as deemed expedient and to have care of county property. K.S.A. 19-101 allows counties to make contracts and do all other acts in relation to county property. K.S.A. 19-2801 et seq. allows counties broad authority to operate recreational facilities and activities.
This event has taken place in the park previously. Similar terms and conditions have been in prior agreements although with a shorter term. A certificate of insurance approved by the office of the county counselor is required pursuant to section 5 of the agreement.
Policy Considerations: None.
