Title
CONSIDERATION OF THE ANNUAL BUREAU OF JUSTICE ASSISTANCE, STATE CRIMINAL ALIEN ASSISTANCE PROGRAM (SCAAP) FY‘19 GRANT APPLICATION.
Presented by: Marty Hughes, Revenue Manager, Accounting Department
RECOMMENDED ACTION: Approve submission of the grant application by the County Revenue Manager as “submitting government official” as required by the grant and if awarded authorize acceptance of the grant award.
Body
The SCAAP Grant provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens who have at least one felony or two misdemeanor convictions for violations of state or local law, and who are incarcerated for at least four consecutive days during the reporting period. State and local units of government that have authority over correctional facilities that incarcerate or detain undocumented criminal aliens for a minimum of four consecutive days are eligible to directly apply for SCAAP funds. State and local units of government include the 50 state governments, the District of Columbia, Guam, Puerto Rico, the U.S. Virgin Islands, the Commonwealth of the Northern Mariana Islands, and American Samoa and more that 3,000 counties and cities with correctional facilities.
The FY 2019 program is authorized by 8 U.S.C. § 1231(i) and the Department of Justice Appropriations Act, 2019 (Public Law 116-6). See also 28 U.S.C. § 530C(a). As a matter of federal law, a “State” or “unit of local government” that receives a payment under the FY 2019 program must use the payment “only for correctional purposes”. Beginning with FY 2007 SCAAP awards, SCAAP funds must be used for correctional purposes only and deposited into the General Fund. This application covers the period July 1, 2017 through June 30, 2018 and involves providing alien inmate data for the period, staffing and salary costs of corrections staff, total inmate days, and total bed count.
In the attachment section of this agenda item there is a page from the application instructions packet titled, “A general overview of the method OJP uses to calculate payments under SCAAP”. This page provides the seven step process used to calculate the distribution of appropriated funds for the 2019 program. The congressional appropriation for FY 2017 was $210 million, FY 2018 was $240 million and for FY 2019 it is $100 million. Most recently Sedgwick County received an award of $41,519 for FY 2017, and with this 52% decrease in funding appropriation we would expect no more than $25,000 award amount for FY19. A historical perspective of previous SCAAP awards is also provided in the attached documentation.
