Title

RESOLUTION CREATING A ROAD IMPROVEMENT BENEFIT DISTRICT IN SEDGWICK COUNTY, KANSAS AND AUTHORIZING IMPROVEMENTS THEREIN (CESSNA ADDITION). DISTRICT 2.

Presented by: Joe L. Norton, Gilmore and Bell, P.C., Bond Counsel.

RECOMMENDED ACTION: Adopt the resolution.

Body

Cessna Aircraft Company is preparing to expand their parts facility located at the southeast corner of Ridge Road and K-42 Highway.  This will significantly increase the number of trucks utilizing the facility and require construction of a new entrance to the site.  In order to accommodate these changes, the left turn bay must be extended farther south on the property.  The road improvements occurs in County right of way and the special assessment process is the best tool available to create a County project to complete the work.  Cessna intends to pay off the total project cost after the project is completed and final costs are known.  No bonds are needed.

A petition requesting the creation of the road improvement benefit district and the construction of the road improvements has been filed with the County Clerk.  The petition was signed by the owners of 100% of the property within the proposed district as determined by Sedgwick County Public Works.  The property is currently a single platted lot that would bear the entire cost of the improvements.

Alternatives:  Deny the petition.  If the petition is denied, Public Works and the property owners would have to find some other suitable method to finance and construct the improvements.

Financial Considerations:  The total estimated project cost is $146,300.00.  The resolution authorizes the sale of bonds to finance the project but Public Works has been informed by Cessna that they intend to pay off the actual project costs in cash after they are known but prior to the sale of bonds.

Legal Considerations:  K.S.A. 68-728 et seq. as amended by Sedgwick County Charter Resolution No. 61 authorizes the creation of road improvement benefit districts.

Policy Considerations:  Approval of the resolution will create a special assessment project.  Individual special assessment projects are not listed in or authorized within the Capital Improvement Program. These projects are completed in accordance with policies and procedures outlined in the Debt Management Policy.  The policy establishes debt limits for the County as well as requirements for posting letters of credit guaranteeing payment of property taxes and special assessments on projects in new developments.  In this case, letters of credit are not required because the property is already developed.  Professional services contracts and construction contracts required to complete the project are submitted to the Board of County Commissioners for approval in separate action.
