Recommended Action: Approve the Resolution.
On June 11, 2003, the Board of County Commissioners of Sedgwick County enacted Resolution No. 138-03 establishing a daily fee for inmates placed in a work-release program as authorized by K.S.A. 19-1930(d). Any inmate who participates in the work release program shall be charged and required to pay the participation fee by the fee schedule adopted by the Director of Corrections, and such fees shall be used to defray costs of maintaining such inmate.
Alternatives: Do not approve the Resolution.
Financial Considerations: The Director of Corrections shall adopt a fee schedule establishing the amount of fee payable by participants up to $20.00 per day in proportion to the compensation received by the inmate, and, the Director, upon request, may waive the fee in instances where payment would create undue hardship for an inmate.
Legal Considerations: The Resolution has been "Approved As To Form" by the Assistant County Counselor. The authority for this action is K.S.A. 19-101. A simple majority vote is required.
