Title
Second Amendment to Lease Agreement between Carl Linder and Betty Linder and Sedgwick County for space at 1720 E. Morris, Suites 1 and 2, Wichita, Kansas for COMCARE - Sedgwick County Offender Assessment Program (SCOAP).

Body
Recommended Action: Approve the Amendment.

Background: Sedgwick County has leased space at 1720 E. Morris since 1999. Sedgwick County COMCARE moved into the space in 2006 and occupies approximately 6,620 square feet. This space houses COMCARE's Sedgwick County Offender Assessment Program (SCOAP). A Capital Improvement Project was recently completed in the facility, resulting in a building remodel that expanded the client capacity from 4 to 12.

A “Refund of Construction Costs” section was added into the current lease. This clause protects the County’s investment of $85,652.00 in the unlikely event that the landlord requests to terminate the lease prior to the end of the term. Likewise, the lease term was extended through December 31, 2018, along with two additional one-year renewal terms, potentially extending the lease through December 31, 2020. This ensures that the program will have the continued ability to use the remodeled facility for the foreseeable future.

The County retains the standard option to terminate the lease with a 180 day notice and the monthly lease rate is scheduled to remain at the current rate of $3,709.03, or $6.72 per square foot.

Alternatives: The BOCC could choose not to approve this Second Amendment to Lease Agreement, in which case COMCARE would continue to operate under the terms of the First Amendment to lease, however the lease term would be shorter and the County’s Capital Improvement investment would not be protected against lease termination.
