Title
Resolution providing for the Conveyance of certain real property located in Sedgwick County, Kansas.

Body
Recommended Action: Adopt the resolution and authorize the chairman to sign.

In 1953 the Board of County Commissioners formed the Main Sewer District No. 3, and took title to certain property located in adjacent to the Park City Improvement District for the purposes of constructing and operating a sewage treatment plat. The Board served as the governing body of the Sewer District. On June 14, 1973, at a special meeting of the Board, it approved the conveyance, by quitclaim deed, of the property, subject to review and approval by the County Counselor. According to the minutes, the Improvement District had been the intended owner / operator of the plant, and that sometime after construction, the Improvement District had taken over maintenance and operation, but title had never been transferred. A recent title search did not show any quitclaim deed recorded after the June 14, 1973, meeting that would conveyed title of record to the Improvement District. In 2003, an entry was made in the County transfer record by the Clerk's office to change the mailing address for tax statements to the City of Park City, Kansas.

Alternatives: None. Park City, and its predecessor Improvement District, has been in sole possession of the property since at least the 1970s. The purpose of the resolution is to clear up the title issue by filing a replacement quitclaim deed.

Financial Considerations: None

Legal Considerations: The Board is authorized by K.S.A. 19-101 third to convey title to real estate property owned by the County, either in its name or as successor in interest to the no longer operating Sewer District.

Policy Considerations: None.
