Recommended Action: Approve the notice of hearing.
On May 16, 2014, a petition was filed with the County Clerk requesting the BoCC hold a hearing on attachment of land to Harvey County Rural Water District No. 1. Notice of the hearing is then sent by first class mail to the landowners of the area proposed for attachment, the rural water district and the chief engineer for the state division of water resources.
Alternatives: The BoCC is required to set a hearing date within thirty days of the receipt of petition; the BoCC could set the hearing for a different date.
Financial Considerations: None.
Legal Considerations: K.S.A. 82a-622 provides that upon the filing of a petition for attachment of land to a rural water district, the petition is presented to the BoCC, which is then required to set a hearing date.
