Title
Set hearing date for petition for attachment of land to Rural Water District.

Body
Recommended Action: Approve the notice of hearing.

The County Clerk, on November 14, 2013, received a petition for attachment of land to Rural Water District No. 3, requesting the Board set a hearing date for the petition. The petition was supplemented by subsequent filings and meets the statutory requirements set out in K.S.A. 82a-622. The land proposed for attachment is within the fringe area, defined as 3 miles, of the city limits of the cities of Derby and Wichita.

Alternatives: None. The Board is required to set a hearing date as further explained in the Legal Considerations section.

Financial Considerations: None.

Legal Considerations: The process for attachment of land to a rural water district is governed by K.S.A. 82a-622, et seq. If a petition meeting the statutory requirements is received by the County Clerk; the Clerk gives notice of the filing of the petition to the Board, and then the Board is required to set a hearing date. Notice of the hearing, and a copy of the petition, must be sent to the landowner involved; the rural water district and the chief engineer of the Division of Water Resources in the Kansas Department of Agriculture. When the land is within the fringe area of a city, notice of the hearing must also be published in the official county newspaper at least seven days prior to the hearing date.

Policy Considerations: None.
