Body
Recommended Action: Adopt the resolution.
In 2011, the Kansas Legislature made a change to statute requiring Scrap Metal Dealers to register with their respective county. Per statute, the Board of County Commissioners reviews and either accepts or rejects these registrations. The purpose of this resolution is to establish the fee for application and set up a process for review and registration.
Alternatives:
Financial Considerations: No significant impact on expenditures and revenue is expected from the recommended action.
Legal Considerations:K.S.A. 19-101 et seq provides authority for this action. K.S.A. 50-6,112a prohibits any business from purchasing regulated scrap metal without having first registered each place of business as provided in that statute. This requirement was added by the state in 2011. Registrations must be made to the Board of County Commissioners when the business is located outside the corporate limits of a city. The Sedgwick County Clerk's Office has agreed to be the contact point for submission of and processing of these applications. K.S.A. 50-6,112a provides the minimum amounts to be charged for such registrations are $100.00 for original registrations and $25.00 for renewal registrations.
