RECOMMENDED ACTION: Approve the amendment, authorize the Chairman to sign, and authorize the necessary budget authority.

Background: The Mental Health Association of South Central Kansas, Behavioral Link, Urban League, Youthville, and DCCCA are all contracted with COMCARE to provide a variety of services to our consumers, including attendant and respite care, professional family resource care, psychosocial rehabilitation group and individual services, and case management. In January 2010, the State of Kansas implemented a ten percent cut in the rates agencies were reimbursed for providing these Medicaid reimbursed services. Starting on July 1, 2010, however, that cut was reversed, and rates returned to their 2009 levels. As a result, the contracts between COMCARE and the aforementioned organizations must be amended to reflect this increase in Medicaid rates so that they are reimbursed for the properly ` for the services they provide.

Analysis: Contracts are in place so that the organizations named above receive payment(s) for the Medicaid service(s) they provide. Accordingly, the contracts should reflect the appropriate reimbursement rate for service provision, and as such must be amended to document the increase in rates. The amendment does not affect the contract compensation caps for the agreements. Additionally, all payments to agencies under these agreements are funded through Medicaid revenue in a fee-for service arrangement, so there is no net increase to cost to COMCARE grants or general fund dollars.

Alternatives: The amendment lists the revised rate for services effective July 1, 2010. Without the amendment the contracts would not specify the correct rates to be paid.
