Body
Resource Recovery Management, LLC has proposed a construction and demolition (C&D) landfill to be located near the intersection of 55th Street South and Ridge Rd.  Sedgwick County's C&D  landfill regulations do not allow a C&D landfill within 1 mile of a public supply water well.  This proposed C&D landfill is within 1/2 mile of a public supply water well.  The Sedgwick County Solid Waste Management Committee recommended that a third party consultant, hired by the county, be used to prepare a Groundwater Model Study to determine if a proposed C&D landfill could potentially contaminate a public supply water well.  The County issued an RFP and has selected a company to perform this study.  Resource Recovery Management, LLC has agreed to the scope of the study and the associated costs.   
 
Alternatives:  The County could pay the $88,790 without reimbursement.
 
Financial Considerations:  The study will cost $88,790.  Without this contract, the County would be responsible for the entire cost.  
 
Legal Considerations:  The authority for this action is K.S.A. 19-101, et seq.  A simple majority vote is required.
 
Policy Considerations:  SC Regulation Article X; Sec. 24-402; (f)  No permit to construct or operate a newly permitted C&D facility shall be issued on or after the effective date of this act if such area is located within one (1) mile of an intake point for any public water supply system.  The owner or operator may petition the board of county commisioners for an exception based upon proof of protection of the public water supply system.
