Recommended Action: Approve the agreement and authorize the Chairman to sign.
Wichita State University has requested controlled access to certain portions of County roadways for the purpose of sponsoring the Sunflower State Championship on April 21 and May 19, 2012. The roadway affected is the West Lake Afton Road south of the pavilions and north of Cottonwood Grove Area.
Financial Considerations: Adoption of this agreement has no financial impact on Sedgwick County.
Legal Considerations:
K.S.A. 19-212 vests the Board of County Commissioners with broad powers in conducting the business of the county at a meeting. The county's general police powers allow protection of the public health, safety, and general welfare of the public. This agreement is similar to prior controlled access agreements. However, the standard insurance certificate requirement is waived since Wichita State University is a state educational institution of Kansas and does not maintain insurance as claims are subject to the Kansas Tort Claims Act.
